Conditions of participation

SWING Collections GmbH, Maassenstraße 77, 46514 Schermbeck, is launching a monthly competition via the newsletter starting August 1, 2024 at 00:00. Anyone who has registered via the newsletter registration portal and subscribed to the newsletter can take part. By participating in the competition, the participant accepts the stated conditions of participation and data protection information. In the event of a violation of the conditions of participation or an attempt at technical manipulation, SWING can exclude participants from the competition. In such a case, the prize can also be revoked retroactively and reclaimed.

Participation

a) All persons who are at least 18 years old at the time of participation and who are resident in the Federal Republic of Germany are eligible to participate. Persons who are involved in the conception and implementation of the competition are excluded from participation.

b) Participation in the competition takes place online via the SWING online shop.

c) The monthly competition ends on the last calendar day of the month at 11:59 p.m. The entire competition ends definitively on December 31, 2024. Each month, 5 winners will be chosen by lottery.

d) Each participant may only take part in the competition with one newsletter account. Multiple registrations will result in exclusion.

e) To participate in the competition, the data provided must correspond to the participant's actual data. Incorrect information may lead to exclusion from the competition and possible winnings.

f) Personal data is collected solely for the purpose of conducting the competition. Participants are responsible for the accuracy of the data provided. Personal data will be deleted after the competition has been completed or after the tax and commercial retention periods have expired.

Implementation and processing

a) The respective winners will be selected on the last calendar day of each month by a jury assembled by SWING from among all eligible participants following a comprehensible selection process.

b) The winner will be notified by email within seven working days after the end of the month. If the winner's notification cannot be delivered, SWING is not obliged to conduct any further investigations.

c) SWING reserves the right to extend, terminate or cancel the competition at any time.

d) The following non-cash prizes will be awarded as prizes:

5 x 200 € SWING gift voucher

e) If a winner does not respond within five working days of the prize notification being sent, the right to the prize will expire and a new winner will be determined.

f) The prizes will be sent to the winners by email.

g) Participation via competition clubs or other commercial service providers is excluded.

Early termination of the competition

a) SWING reserves the right to cancel or interrupt the competition at any time without prior notice. This applies in particular if the proper conduct of the competition cannot be guaranteed for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software), due to manipulation of the participation process or for legal reasons.

b) Participants’ claims for performance and compensation in the event of premature termination of the campaign are excluded.

Miscellaneous

a) Legal recourse is excluded. The prize is non-transferable and cannot be paid out in cash.

b) SWING reserves the right to exclude participants from the competition due to violations of the conditions of participation, false information, manipulation (such as the use of automated scripts) or the use of unauthorized aids.

c) The law of the Federal Republic of Germany shall apply exclusively. However, this choice of law shall not apply if the participant would be deprived of the protection afforded to him by mandatory provisions of the law of his habitual residence.

d) Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall take the place of the invalid provisions.

e) Vouchers won are valid for 14 days from the date of issue.

Privacy policy

The responsible body for the processing of your personal data in the context of this competition is SWING Collections GmbH, Maassenstraße 77, 46514 Schermbeck.

We store your personal data in accordance with legal regulations and solely for the purpose of carrying out and processing this competition. The processing is carried out on the basis of consent in accordance with Art. 6 Para. 1 lit. a) GDPR or to fulfill an obligation in accordance with Art. 6 Para. 1 lit. b) of the General Data Protection Regulation (EU 2016/679).

Only the winner's name, first name, address and email address will be recorded and stored solely to verify eligibility to participate and to send the prize. You can object to the use and storage of your personal data at any time without giving reasons. All you need to do is send an informal email to service@swing-collections.com . In the event of an objection, further participation in the competition is no longer possible.

The participant declares that the personal data provided is correct and complete. False and/or incorrect information may lead to exclusion from the competition.

To facilitate reading, we primarily use male terms in the text. This does not imply any gender-specific definition. Members of all genders should be addressed equally.
